Court Strikes Out APC, KWHA Suit, Uphold Jimoh Agboola As Validly Elected


The Federal High Court has ordered the Kwara State House of Assembly speaker, Rt Hon. Yakubu Danladi to immediately swear in Honorable Agboola of PDP as member representing Ilorin South constituency of Kwara State.

The Federal High Court sitting in Ilorin this morning has struck out a suit filed before it by kwara state house of Assembly member, Oluwanilo and the APC challenging the recognition and swearing in of Hon Jimoh Abdulraheem Agboola as member representing Ilorin South State Constituency at the kwara state house of Assembly.

Recall that in November last year, Court of Appeal sitting in Ilorin nullified the election of Oluwanilo, an APC lawmaker as the member representing Ilorin South at the Kwara State House of Assembly and declared Hon. Raheem  Agboola of the PDP as winner of the election, the court also ordered INEC to issue a fresh certificate of return to the PDP candidate and the INEC had obliged .

Honorable Agboola and members of PDP have on several occasion marched peacefully to the Assembly complex to demand swearing in of Agboola but have been resisted forcefully by the security operatives manning the Assembly complex

The court of appeal this morning while reading it judgement struck out the appeal for lacking merit describing it as gross abuse of court processes .

The court also ordered the kwara assembly speaker , Yakubu Danladi to immediately swear in Honorable Agboola of PDP having satisfy all eligibility criteria to be sworn in as member representing Ilorin South constituency.
